DALEVILLE TOWN COUNCIL MEETING
June 11, 2012, 7:30 pm

President Tom Roberts called the meeting to order at 7:30 pm. An invocation was given by Tom Roberts, followed with the Pledge of Allegiance.

Present were Tom Roberts, Bill Walters, Jeff Shore, Jay Shellabarger and Joe Scott.

Jay Shellabarger motioned to waive the reading of the May Council Meeting minutes and accept the minutes as written. , 2nd by Bill Walters. Motion carried with 5 yeas.

Jay Shellabarger motioned to waive the reading of the May 29, 2012 Special & Executive Meeting minutes and accept the minutes as written. , 2nd by Bill Walters. Motion carried with 5 yeas.

Daleville Little League – Erin Scott representing the Little League. She announced a 5K & 1 Mile Fun Run for July 14, 2012. She presented the maps for both walk/run. The Little League is having the Walk/Run to offset cost for the children to participate in the Little League. They are hoping to avoid other fundraisers (candy sales, etc.) by having this event. Jay Shellabarger motioned to close roads in Daleville for the Walk/Run. 2nd by Bill Walters. Motion carried with 5 yeas.

Presentation to Officer Parton – Chief King presented Officer Michael Parton with a retired police badge and Baretta 380 for his service to the Daleville Police Department. The Town Council and members of the town present applauded, thanking Officer Parton for his outstanding service to the Daleville Police Department. Officer Parton thanked the town, council and police department for the honor.

Old Business:

Daleville Road Sidewalk Project – Bill Walters received final drawings from RQAW, they are 90% complete. Bill Walters is meeting with commissioners in Muncie Friday to secure final monies for the project. Bill Walters motioned to pay for the completed work at this time; $35,525 from the EDIT fund. Motion 2nd by Jay Shellabarger. Motion carried with 5 yeas.

Water Board met this evening. Any outstanding water balance 90 days or older the town will pursue. Customers receive a disconnect notice. Jeff Shore has to personally approve any waivers. He then sets up agreement for payment.

Jeff Shore shared the Ordinance 2012-06 pertaining to water payment from the Daleville Little League for water usage. They will be charged $10 per year, for the season running March through October.

DEPARTMENT REPORTS:

Police: Truck purchase for the Town is still processing. There is a possibility of obtaining a truck from Kentucky rather than from Florida. Chief King then explained the process involved in obtaining the vehicles. Vehicles are free and then can be sold after 1-2 years.

Bill Walters read a complaint from Jerry & Diana Scott concerning speed limits on 3rd, 4th, & 5th Streets. Chief King commented if speed limit is not posted, the speed limit is 30 mph. Mr. Walters asked where the school zone ends. Chief King informed the town council that the speed limits within the town can be changed by the council. This is done through an ordinance. All roads would have to be marked accordingly. Bill Walters will research with Chief King to check options. Diana Scott shared her concerns about the speed limits, children walking and the dangers of the speeding cars. She would like someone to investigate possibility of lowering the speed limit in town. Bill Walters will be looking into it. Chief King will have an officer put a radar gun on cars coming down those streets. Chief King asked council to protect department if people complain about being stopped for speeding.

Bill Walters presented bids on police cars: Kahlo – $22,659, Sam Pierce – $28,559.15, Ford – $24,036.72. Bill requested that it be opened back up for discussion. Bill Walters suggested the LEEP program – 3 year Lease for 2 police cars. Payments would be $10,000 per car per year. Cars would be ordered now to take delivery in December. Sam Pierce mentioned the Caprice cars are manufactured overseas, they are specially made for police use, not available to the public. Bill Walters motioned to purchase the 2013 Caprice cars from Sam Pierce. 2ND by Jay Shellabarger . After discussion, Bill Walters withdrew his motion to purchase the Sam Pierce Caprice cars, Jay Shellabarger withdrew his 2nd. Jay Shellabarger motioned to table discussion on the police cars. Bill Walters 2nd the motion. The motion carried with 5 yeas.

Clerk: Jay Shellabarger motioned to accept the claim docket. 2nd by Jeff Shore. Motion carried with 5 yeas.

Streets & Garage: Storm drains finished on Kentucky, Mason & Wayne. Complaint on Atlee. Looking into putting in 2 storm drains on East side of road. Will fold drain from one side to the other and will slow down traffic. Light at St. Rd. 67 will be installed in near future. Steve Sargeant’s drive not finished yet. Bill did reference checks on LICA – all positive comments. INDOT approved. Hot asphalt will come from McIntyre. Bill Walters motioned to approve LICA bid $38,901.66. Jay Shellabarger 2nd motion. Motion carried with 5 yeas.

County is paving 900. If Town pays for asphalt, labor would be free. Bill Chambers needs to be contacted to arrange this.

Sanitation: Port A Pots to be placed at parks for $75/month and will be serviced weekly by Bestway. Joe Scott motioned to spend $150/month for 2 Port A Pots to be placed at park at Town Hall and Shellabarger Park. 2nd by Jay Shellabarger. Motion carried with 5 yeas. Bestway will place where we would like. Port A Pots will have hand sanitizer in the Port A Pot.

Water: Water Board voted to purchase a gas powered compressor. Compressor needed to paint fire hydrants. Spending limited to $1,000. Water Board discussed past due accounts.

Parks: Park Board met and elected Joe Scott President of the Park Board for a 4 year term, Joe Owens as Vice-President for a 3 year term, Corey Scott to a 2 year term, Sally Moon to a 2 year term, Brandon Watson as Secretary for a 1 year term. Joe Scott motioned to accept these individuals as stated. Jay Shellabarger 2nd the motion. Motion carried with 5 yeas. Meetings are the 4th Wednesday of the month. The Park Board will meet on Wednesdays at 8:00 pm at the Town Hall.

Planning & Zoning: Jay Shellabarger explained as permit fees stand in Daleville, it will cost $20,000 in permits to build the shell building being planned for Daleville. With changes, building could be built with inspection cost of $35/visit. Planning & Zoning is wanting to change our fees to adopt the $35/visit cost. Jay continued to compare our fees to Yorktown. Our fees are substantially more than Yorktown and Planning & Zoning is planning to change the fee structure. Our liability if we do an inspection and there is a collapse of the building?

Veterinary Sign – Danny issued permit and told him where he could put sign. Veterinary was responsible for getting a survey.

Mowing fee is increased to $150/employee.

Tree trimming at 5th & Short – quote for $1,500 to trim tree back. Attorney stated that if tree is a hazard and in right-of-way. Town has some responsibility for safety. The attorney referenced the Planning & Zoning book. Town statute states property owner needs to take care of the tree problem.

NEW BUSINESS:

Two Nepotism Policies were explained by the attorney. Jay Shellabarger motioned to introduce Resolution 2012-01 establishing a policy prohibiting nepotism. Bill Walters 2nd. Jay Shellabarger motioned to suspend the rules to allow Resolution 2012-01 establishing a policy prohibiting nepotism to be adopted. Bill Walters 2nd. Motion carried with 5 yeas. Jay Shellabarger motioned to adopt Resolution 2012-01 policy prohibiting nepotism. Bill Walters 2nd. Motion carried with 5 yeas.

Jay Shellabarger motioned to introduce Resolution 2012-02 establishing a policy regarding contracting with the town. Bill Walters – 2nd. Current contracts are grandfathered in. Jay Shellabarger motioned to suspend the rules to allow Resolution 2012-02 establishing a policy regarding contracting with the town. Bill Walters-2nd . Motion carried with 5 yeas. Jay Shellabarger motioned to adopt Resolution 2012-02 establishing a policy regarding contracting with the town. Bill Walters – 2nd. Motion carried with 5 yeas.

Melanie Wright officially announced she was running for State Representative.
